Terms of Service

1. Acceptance of Terms

By accessing or using Menuscope ("the Service"), operated by Menuscope Pty Ltd (ABN: pending registration) ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Menuscope is an AI-powered platform that assists Accredited Practising Dietitians and food service professionals in reviewing institutional menus. The Service automates document parsing, ingredient extraction, nutritional analysis against AUSNUT and AFCD databases, compliance checking, and report generation.

3. Accounts and Eligibility

You must be at least 18 years old and provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Billing and Subscription

  • The Service is offered at $440 AUD per month, billed monthly via Stripe.
  • New accounts receive a 14-day free trial. No payment is required during the trial period.
  • If a payment fails, your account enters a 7-day grace period during which the Service remains accessible. After the grace period, access to premium features is suspended until payment is resolved.
  • You may cancel your subscription at any time via the billing portal. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.

5. Intellectual Property

You retain ownership of all data, documents, and content you upload to the Service. We retain ownership of the Service, its software, design, and underlying technology. Reports generated by the Service are owned by you, the account holder.

6. Clinical Disclaimer

Menuscope is a decision-support tool only. It does not replace professional clinical judgment.

All nutritional analyses, compliance assessments, and recommendations produced by the Service must be independently verified by a qualified healthcare professional before being applied to patient or resident care. The Service is not a medical device and is not intended to diagnose, treat, or prevent any disease or condition.

This Service is not a medical device as defined by the Therapeutic Goods Administration (TGA). Approved Providers under the Aged Care Act 2024 retain full responsibility for ensuring nutritional adequacy under Standard 6 (Food and Nutrition).

7. AI Accuracy Disclaimer

The Service uses artificial intelligence to extract ingredients from uploaded documents and match them to food composition databases. While we strive for accuracy, AI-generated results may contain errors including incorrect ingredient identification, inaccurate quantity parsing, or incorrect food database matches. You are responsible for reviewing and validating all AI-generated outputs before relying on them.

8. Data Processing and Privacy

We process your data in accordance with our Privacy Policy. Uploaded documents are processed to extract structured data and are deleted from temporary storage after processing. We do not sell your data to third parties. Data is stored on servers located in Australia (Sydney, ap-southeast-2).

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Interfere with the security or integrity of the Service
  • Share account credentials with unauthorised third parties
  • Upload documents containing malicious code or content

10. Limitation of Liability

To the maximum extent permitted by Australian law, Menuscope Pty Ltd and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Menuscope Pty Ltd from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on Service outputs without independent professional verification.

12. Service Availability

We aim to provide continuous access to the Service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We are not liable for any downtime or service interruptions.

13. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
